“#WeAreMagenius Halloween Giveaway” (the “Giveaway”) is organized and promoted by Qingdao Magene Intelligent Technology Co., Ltd. (the “Promoter”) and is subject to the following terms and conditions.
To participate in the Giveaway, follow the instructions and accept the following terms and conditions, which will form a binding agreement between you (the “Participant”) and the Promoter.
- The Giveaway and How to Participate
1.1. By participating in the Giveaway, you hereby accept these participation rules (referred to hereafter as “the Rules”). If you do not wish to accept these Rules, please do not participate.
1.2. The Participant must be a registered member of Instagram and should be a follower of the Promoter’s (@mageneofficial) account.
1.3. The Participant must join the giveaway by publishing a cycling-related post (Instagram story excluded) under the hashtag #wearemagenius.
1.4. Each participant must tag at least 2 Instagram users as required when publishing the post.
1.5 This giveaway starts at announcement post publishing time, 17th Oct 2022 and will end at 23:59 (UTC+08 ) on 31st Oct 2022.
1.6 The winners of the giveaway will be announced, and winners will receive a notification message from the Promoter on 4th Nov 2022.
1.7 To qualify for participation in the giveaway, you must be over 18 years of age. If under 18 years of age, you must first obtain permission from a parent or legal guardian.
1.8 Giveaway is open to all countries. You understand and agree that not all the giveaways can be delivered successfully due to the requirement of applicable laws or logistics problems in your country or region. In such an event, the Promoter shall have the right to suspend such giveaway without any legal liabilities. If immediate delivery of the prize is not possible due to force majeure and epidemic control in the promoter’s area, you understand and agree that the promoter may postpone delivery of the prize.
- Prizes
2.1 The top three participants with the most likes on their participation posts during the giveaway period will be awarded a Magene L508 Radar Tail Light. In addition, 3 randomly selected participants will receive a Magene C406Pro GPS Smart Bike Computer.
2.2 In cases where a prize cannot be delivered due to causes originating with the winner (including but not limited to failure to provide contact information within 72 hours of the conclusion of the event or submission of incomplete or inaccurate contact information that prevents the Promoter from establishing contact) the prize will automatically be considered waived. The Promoter assumes no responsibility for any such outcome and will not reissue the prize in such cases. Upon receiving their prizes, winners will be expected to confirm the completion of delivery by notifying the Promoter directly. Promoter shall not be liable for any accidents or damages suffered by winners relating to the use or receipt of prizes.
2.3 Prizes may not be exchanged for cash. If unforeseen circumstances prevent the distribution of a prize, the Promoter reserves the right to issue another prize in its place. Replacement awards may not be exchanged for cash either.
2.4 Prize recipients shall bear full responsibility for any taxes such as tariffs incurred with their prizes. The Promoter shall bear full responsibility for any shipping charges incurred by the delivery of the prize.
2.5 Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed, or lost in transit.
- Waiver of Liability
3.1 This promotion is in no way sponsored, endorsed, administered by, or associated with, Instagram. Participants understand that they are providing their information to the Promoter and not to Instagram. The information a participant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments, or complaints about this promotion must be directed to the Promoter and not to Instagram.
- Changes to the Rules
4.1 Promoter reserves the right to make reasonable adjustments to the above terms and conditions in keeping with standard practices for similar events. Please refer to these terms regularly to ensure you are aware of and understand any changes made by the Promoter. You accept these terms and conditions as legally binding regardless of any changes occurring herein.
- Privacy and Personal Information Policy
5.1 Personal information collected from each winner will be used by the Promoter to deliver their prize. And after the delivery is completed, the Promoter will delete all the personal information. The Promoter will not sell, share or otherwise disclose the personal information of winners with third parties, other than to third parties engaged by the Promoter to fulfill the above purposes.
